Terms of Service

Overview

Kindtact is a QR-based contact platform that lets you attach a QR code to an item, vehicle, sign, property, or product so someone who scans it can contact the owner without exposing the owner's personal contact details. These Terms apply to your access to and use of Kindtact, including accounts, QR codes, landing pages, messages, stickers, subscriptions, and all related services. By using Kindtact, you agree to these Terms.

Eligibility and accounts

Acceptable use

You must not use Kindtact to harass, threaten, abuse, stalk, discriminate against, or intimidate any person; commit fraud, scams, phishing, or identity misuse; promote or carry out illegal activity; send spam or automated abuse; upload or send harmful, offensive, misleading, or unlawful content; or attempt to bypass security measures, scrape data, or access accounts without authorisation.

User messages and content

Users and scanners are responsible for the messages, replies, and other content they send. Kindtact may review, moderate, block, remove, or report content where necessary for safety, legal compliance, or service integrity. Content sent through the service is not endorsed by Kindtact.

Privacy and personal information

Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information. Kindtact is designed so owner contact details stay hidden unless the owner chooses to disclose them. We operate with awareness of applicable privacy laws including GDPR, UK GDPR, the Australian Privacy Act, CCPA, New Zealand Privacy Act, and similar laws elsewhere.

Safety and no emergency use

Kindtact is not an emergency service. If a situation is urgent, dangerous, or life-threatening, contact police, emergency services, or the relevant authority immediately. We do not guarantee item recovery, vehicle safety, or that any contact attempt will succeed.

QR codes and scanning risks

People scan QR codes at their own discretion. While Kindtact is designed to provide safer contact, we do not guarantee that QR codes cannot be copied, misused, damaged, redirected, or tampered with. You are responsible for placing and using QR codes lawfully and safely.

Payments, subscriptions and refunds

We may offer paid products, subscriptions, renewals, and other paid features. By purchasing a paid plan, you authorise us and our payment processor to charge applicable fees, including recurring charges until you cancel. You can cancel from your account settings. Cancellation usually stops future renewals but you keep access until the end of the current billing period. Refunds are not provided except where required by applicable consumer law or stated otherwise in writing.

Consumer law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot legally be excluded, including rights under Australian Consumer Law and other mandatory consumer protections.

Intellectual property

Kindtact owns or licenses the platform, software, brand, QR system, designs, templates, and related intellectual property. You may use QR codes, stickers, and related assets only as permitted by these Terms. Do not copy, resell, sublicense, or reverse-engineer any part of the service except as permitted by law.

Disclaimers

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee uninterrupted, secure, error-free, or always-available operation, or that any message will be delivered, any QR code will function forever, or any item will be returned.

Limitation of liability

To the maximum extent allowed by law, Kindtact and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost property, or business interruption. To the extent liability cannot be excluded, it is limited to the amount you paid to Kindtact for the service giving rise to the claim. Nothing limits non-excludable consumer law rights.

Indemnity

If Kindtact suffers claims, losses, damages, costs, or expenses arising from your unlawful use of the service, content you send, breach of these Terms, or infringement of another person's rights, you agree to cover those losses to the extent permitted by applicable law.

Suspension and termination

We may suspend or terminate your account, QR links, or access if we have a reasonable basis to believe there is serious misuse, a security concern, non-payment, or a material breach of these Terms. We will act proportionately and, where practical, give notice.

International use

Kindtact is operated from Queensland, Australia. Users may access the service internationally. You are responsible for complying with the laws that apply where you use Kindtact. These Terms are governed by the laws of Queensland, Australia, unless another law or forum must apply. Mandatory consumer rights in certain jurisdictions are not excluded where they cannot legally be excluded.

Changes to these terms

We may update these Terms from time to time. If we make a material change, we will try to provide reasonable notice. Continued use after updated Terms take effect means you accept them.

Service changes and closure

We may change, pause, discontinue, sell, transfer, or close the service at any time, subject to applicable law. QR codes, landing pages, redirects, and related digital features may stop working if the service changes, closes, or if there is a technical failure, account termination, or non-payment. We are not liable for losses caused by QR codes or stickers no longer functioning in those circumstances. We do not guarantee lifetime availability of any QR code or redirect unless agreed otherwise in writing.

Scripture, quotes, and third-party content

Kindtact allows users to include Scripture passages, verse excerpts, inspirational quotes, and other third-party text on their pages. You are responsible for ensuring that any text you upload or display complies with the copyright terms of the source you are using. Many historical Bible translations (such as the KJV) and classical texts are in the public domain. Short quotations used for personal, non-commercial, or devotional purposes may qualify under fair dealing or fair use depending on your location. Where a translation requires attribution, please include it in your content. Scripture and quotes displayed through Kindtact are for personal inspiration only — not theological, doctrinal, pastoral, or professional advice. Kindtact does not endorse any particular religious interpretation or tradition.

Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. Subject to non-excludable consumer rights, the courts of Queensland, Australia will have exclusive jurisdiction.
