Terms of Service

Overview
Kindtact is a QR-based contact platform that lets you attach a QR code to an item, vehicle, sign, property, or product so someone who scans it can contact the owner without exposing the owner's personal contact details unless the owner chooses to do so. These Terms apply to your access to and use of Kindtact, including accounts, QR codes, landing pages, messages, stickers, subscriptions, and all related services. By using Kindtact, you agree to these Terms.
Eligibility and accounts
- You must be at least 16 years old to use Kindtact, or older if required by local law.
- You must provide accurate, current, and complete account information and keep it updated.
- You are responsible for keeping your login details secure and for all activity on your account.
- You are responsible for the QR codes, links, labels, pages, and items you connect to your account.
- If you use Kindtact for a business or organisation, you confirm you have authority to bind that entity to these Terms.
Acceptable use
You must not use Kindtact to harass, threaten, abuse, stalk, discriminate against, or intimidate any person; commit fraud, scams, phishing, impersonation, or identity misuse; promote or carry out illegal activity; send spam, bulk messaging, unsolicited commercial messaging, or automated abuse; upload or send harmful, offensive, misleading, or unlawful content; upload sexual, violent, hateful, harassing, or otherwise inappropriate images, or images of any person without their consent; upload images you do not have the right to share; upload images of minors except where strictly necessary for the legitimate purpose of the QR (for example, returning a lost child's item to their parent); or attempt to bypass security measures, scrape data, or access accounts without authorisation.
User messages and content
Users and scanners are responsible for the messages, replies, photo attachments, and other content they send. Kindtact may review, moderate, block, remove, restrict, preserve, or report content where necessary for safety, legal compliance, abuse prevention, or service integrity. Content sent through the service is not endorsed by Kindtact.
Automated image moderation. Photo attachments from anonymous scanners are automatically screened by a third-party content-moderation service (OpenAI's omni-moderation-latest model) before delivery to the owner. Images classified as sexual, violent, self-harm, hateful, or harassing are withheld and deleted from our storage; the accompanying text is still delivered with a neutral notice that an image was withheld. We do not guarantee that moderation catches every prohibited image or never flags a legitimate one. If you believe your content was withheld in error, contact hello@kindtact.com. Where an automated decision has restricted your account, you can appeal it through the in-app appeal flow.
Automated message moderation and the rephrase step. Message text is screened by the same service before delivery. Content classified as severe is not delivered, and we do not tell the sender why — deliberately, so that someone sending abuse cannot use our response to work out what would get through. Content that reads as hostile but falls short of that threshold is declined with an invitation to reword it and send again. A message declined this way is not stored and does not use up any allowance; the sender can rewrite it themselves or ask for an AI-suggested rewrite — see the Privacy Policy for what is sent to our AI provider and when.
Your licence to Kindtact. By submitting content (including text and images) you grant Kindtact a non-exclusive, royalty-free, worldwide licence to host, store, transmit, scan for safety/abuse purposes, and display that content to the intended recipient (and, where applicable, to our service providers) for as long as is necessary to deliver the service. You retain ownership of your content.
Privacy and personal information
Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information. Kindtact is designed so owner contact details stay hidden unless the owner chooses to disclose them. We operate with awareness of applicable privacy laws including GDPR, UK GDPR, the Australian Privacy Act, CCPA, New Zealand Privacy Act, and similar laws elsewhere.
Safety and no emergency use
Kindtact is not an emergency service. If a situation is urgent, dangerous, or life-threatening, contact police, emergency services, or the relevant authority immediately. We do not guarantee item recovery, vehicle safety, or that any contact attempt will succeed.
QR codes and scanning risks
People scan QR codes at their own discretion. While Kindtact is designed to provide safer contact, we do not guarantee that QR codes cannot be copied, misused, damaged, redirected, or tampered with. You are responsible for placing and using QR codes lawfully and safely.
Owners may optionally enable the "share my phone on the scan page" toggle in their dashboard, which causes their verified phone number to be displayed to anyone who scans one of their QR codes as a "Call the owner" link. Enabling this setting is your choice. By turning it on you accept that the number will be publicly visible to every scanner of every QR registered to your account until you turn it off, and you are responsible for any communications you receive as a result. Kindtact does not screen, route, record, or charge for calls placed via that link; the call is placed by the scanner's own device directly to your number.
Scanners who tap the "Call the owner" link will reveal their own caller ID to the owner in the same way as any ordinary phone call, unless they withhold it using their carrier's standard caller-ID-block feature. Scanners who prefer to remain anonymous should use the on-page message form instead.
Payments, subscriptions and refunds
We may offer paid products, subscriptions, renewals, and other paid features. By purchasing a paid plan, you authorise us and our payment processor to charge applicable fees, including recurring charges until you cancel. You can cancel from your account settings. Cancellation usually stops future renewals but you keep access until the end of the current billing period. Refunds are not provided except where required by applicable consumer law or stated otherwise in writing.
Promotional plans. From time to time we may offer promotional plans, trials, or discounts. Promotional plans are subject to the same fair-use limits published for that tier (QR allowance, monthly message caps, SMS allowance, and any other quotas), which we may adjust from time to time. We may modify, suspend, or discontinue a promotional plan with reasonable notice. Promotional benefits are tied to your Kindtact account, are non-transferable, and end if the account is closed or terminated under these Terms.
Sticker and tag purchases
When you buy a printed sticker pack, you choose one or two headlines that appear above the QR on every sticker in the pack. Once your order is sent to print these headlines cannot be changed — the physical stickers in your hands must always match the design we shipped.
A keyring tag carries a different design — a QR code and a short centre phrase, with no headline — which you choose at checkout. As with a sticker pack, once your order is sent to print or production this design cannot be changed.
The number of QR codes you can manage on your account is determined by your plan. Buying a sticker pack or a tag does not change the QR allowance on your plan; if you need more QRs than your plan covers, switch plans before activating additional stickers or tags.
Sticker pack and tag purchases are non-refundable once your order has been queued for print or production, except where required by applicable consumer law (see "Consumer law" below).
Guest checkout and activation
You can buy a sticker pack or a tag without first creating an account. We collect the email address you provide at checkout solely to send you a one-click activation link, which creates a Kindtact account so your paid stickers or tags can be attached to it.
If you do not activate, we keep your order details — including that email address — for up to 90 days so you can claim them. After 90 days the order is automatically deleted and the stickers or tags in your hands (if already shipped) will scan but cannot be managed.
When you activate, your account becomes subject to the rest of these Terms and to our Privacy Policy.
Consumer law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot legally be excluded, including rights under Australian Consumer Law and other mandatory consumer protections.
Intellectual property
Kindtact owns or licenses the platform, software, brand, QR system, designs, templates, and related intellectual property. You may use QR codes, stickers, tags, and related assets only as permitted by these Terms. Do not copy, resell, sublicense, or reverse-engineer any part of the service except as permitted by law.
Disclaimers
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee uninterrupted, secure, error-free, or always-available operation, or that any message will be delivered, any QR code will function forever, or any item will be returned.
Limitation of liability
To the maximum extent allowed by law, Kindtact and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost property, or business interruption. To the extent liability cannot be excluded, it is limited to the amount you paid to Kindtact for the service giving rise to the claim. Nothing limits non-excludable consumer law rights.
Indemnity
If Kindtact suffers claims, losses, damages, costs, or expenses arising from your unlawful use of the service, content you send, breach of these Terms, or infringement of another person's rights, you agree to cover those losses to the extent permitted by applicable law.
Suspension and termination
We may suspend or terminate your account, QR links, or access if we have a reasonable basis to believe there is serious misuse, a security concern, non-payment, or a material breach of these Terms. We will act proportionately and, where practical, give notice.
International use
Kindtact is operated from Queensland, Australia. Users may access the service internationally. You are responsible for complying with the laws that apply where you use Kindtact. These Terms are governed by the laws of Queensland, Australia, unless another law or forum must apply. Mandatory consumer rights in certain jurisdictions are not excluded where they cannot legally be excluded.
Changes to these terms
We may update these Terms from time to time. If we make a material change, we will try to provide reasonable notice. Continued use after updated Terms take effect means you accept them.
Service changes and closure
We may change, pause, discontinue, sell, transfer, or close the service at any time, subject to applicable law. QR codes, landing pages, redirects, and related digital features may stop working if the service changes, closes, or if there is a technical failure, account termination, or non-payment. We are not liable for losses caused by QR codes or stickers no longer functioning in those circumstances. We do not guarantee lifetime availability of any QR code or redirect unless agreed otherwise in writing.
Scripture, quotes, and third-party content
Kindtact allows users to include Scripture passages, verse excerpts, inspirational quotes, and other third-party text on their pages. You are responsible for ensuring that any text you upload or display complies with the copyright terms of the source you are using. Many historical Bible translations (such as the KJV) and classical texts are in the public domain. Short quotations used for personal, non-commercial, or devotional purposes may qualify under fair dealing or fair use depending on your location. Where a translation requires attribution, please include it in your content. Scripture and quotes displayed through Kindtact are for personal inspiration only — not theological, doctrinal, pastoral, or professional advice. Kindtact does not endorse any particular religious interpretation or tradition.
Governing law and disputes
These Terms are governed by the laws of Queensland, Australia. Subject to non-excludable consumer rights, the courts of Queensland, Australia will have exclusive jurisdiction.
